Regulations of the loyalty programme - sweeek club

Article 1: Purpose and Membership of the Programme

The purpose of these regulations is to define the conditions of membership and operation of the sweeek club loyalty programme (hereinafter referred to as the ‘Programme’) set up by WALIBUY SAS, with a share capital of €654,940.00, registered in the Lille Métropole Trade Register under number 518 047 014, and whose registered office is located at 270 Avenue de l'Espace, 59118 WAMBRECHIES, France (hereinafter referred to as ‘the Company’).

1.1. Membership

Membership of the Programme is free of charge and reserved for individuals of legal age (18 years and over) acting as consumers for their personal needs.

Membership of the Programme is subject to the prior creation of a Customer Account on the e-commerce website www.sweeek.co.uk. It must be finalised by the Member by ticking the dedicated membership box, either when creating the said Customer Account or subsequently from their personal space 'My Account' > 'My loyalty programme'; this action implies the express and unreserved acceptance of these Terms and Conditions.

Only one membership per person (same surname, first name, email address) is permitted. Membership and the benefits associated with it are strictly personal and non-transferable.

1.2. Duration

The Programme is established for an indefinite period. The Company reserves the right to modify or terminate it at any time (see Article 5).

1.3. Territorial scope

The Programme applies:

(i) to purchases made on e-commerce sites operated by the Company and intended for consumers residing in the European Union and the United Kingdom;

(ii) to purchases made in the Company's stores in France, where applicable operated by affiliates of the Company.

 

Article 2: Operation of the Loyalty Programme

2.1. Earning Points

The Programme operates on the basis of accumulating loyalty points (hereinafter referred to as ‘Points’) in accordance with the following terms and conditions:

  • Each purchase made on the e-commerce website www.sweeek.co.uk entitles the customer to earn Points.
  • The accumulation scale is as follows: £1 purchase (including VAT, excluding shipping costs) = 1 Point.
  • Points are credited to the Customer Account after the order has been confirmed.

2.2. Points Balance and Validity

  • Members can view their Points balance at any time in their personal ‘My Account’ area on the website, under the ‘My loyality programme’ section.
  • Points accumulated are valid for twenty-four (24) months from the date of acquisition, subject to activity on the Customer Account.
  • A Customer Account is considered active as long as the Member performs at least one action (purchase, login to the personal space, use of points) within a period of thirty-six (36) consecutive months.

2.3. Deduction of Points

  • In the event of a return of products or cancellation of an order that earned Points, the corresponding Points will be automatically deducted from the Member's balance.
  • If the Points balance becomes negative as a result of a deduction, the Member will not be able to earn new benefits until they have brought their balance back to zero or above zero through new purchases.

 

Article 3 : Use of Vouchers

3.1. Automatic Allocation of Vouchers

The Programme operates on a tiered points system. Members are automatically credited with a Voucher directly in their customer area, according to the following rule:

A £15 Voucher is allocated for every 300 Points accumulated.

Points are accumulated continuously: 300 points accumulated = £15 voucher, 600 points accumulated = £30 voucher, 900 points accumulated = £45 voucher, 1,200 points accumulated = £60 voucher, and so on. Example: 1,800 points accumulated = £90 voucher.

Members do not need to take any action to convert their points: the Voucher is automatically available once the threshold has been reached.

3.2. Terms and conditions of use for Vouchers

Vouchers are valid for a period of 6 months from the date of issue.

The vouchers can be used in one or more instalments.

  • If the amount of the new order exceeds the value of the available Voucher (credit): The credit will be used in its entirety. The Member must pay the remaining amount of the order by another means of payment.
  • If the amount of the new order is less than the value of the available Voucher (credit): Only the portion of the credit corresponding to the total amount of the order will be deducted. The balance of the credit note will remain available in the customer area for future use.

In the event of the return of an order paid for in part or in full by a Voucher (credit note), the Voucher will not be reactivated and no refund of the value of the Voucher (credit note) will be made.

In the event of withdrawal or return due to legal non-compliance:

  • Amounts paid in cash shall be refunded in accordance with applicable law;
  • The portion paid by means of a Voucher issued by the Programme shall be credited back in the form of a Voucher of the same amount or Points of equivalent value.

3.3 Purchase Voucher Limit (Security)

The automatic issuance of Vouchers is limited to £500 per single order (i.e. 10,000 Points).

For any order of £10,000 or more, and if you are a private Member (consumer), you must contact Customer Service after confirming your order to have the Points credited manually (after verification) and receive the credit note.

 

Article 4 : Modification, Suspension and Termination

4.1. Modification of the Programme

The Company reserves the right to unilaterally modify these regulations, the scale for acquiring or using Points, or the benefits of the Programme.

  • Any modification will be brought to the attention of Members by notification (e-mail or posting on the website) with a minimum of 30 days' notice before it comes into effect.
  • Continued use of the Programme after the amendments come into effect constitutes acceptance of those amendments by the Member.

Any substantial change (points scale, benefits, terms of use) is non-retroactive and does not affect:

  • points already earned;
  • vouchers already issued (usable during their period of validity).

4.2. Termination of the Programme

The Company may terminate the Programme at any time.

  • In the event of permanent termination, Members will be notified by email with 30 days' notice.
  • Points earned may be used during a grace period of 3 months from the date of termination of the Programme. After this period, any unused Points will be permanently lost.

4.3. Exclusion

The Company reserves the right to suspend or permanently exclude a Member from the Programme in the event of non-compliance with these Terms and Conditions or proven fraud (e.g. use of multiple accounts, falsification of purchases). Exclusion will result in the immediate and permanent loss of all Points and Vouchers acquired.

In the event of suspected fraud (multiple accounts, falsification of purchases), the Company may temporarily suspend the Account and notify the Member.

The Member has ten (10) days to submit their comments.

After reviewing both sides of the argument, the Company may close the case, reinstate the Account, or decide to exclude the Member.

The consequences (loss of Points/Vouchers) are proportionate to the fraud detected.

An internal appeal process is available.

 

Article 5 : Personal Data and Applicable Law

5.1. Protection of Personal Data (GDPR)

The data collected as part of the Programme (purchase history, points balance, etc.) is processed by the Company for the purposes of the Programme (management of Points, granting of benefits, communication of personalised offers).

When membership or use of the Programme takes place in-store, the data strictly necessary for the creation and management of the Loyalty Account is transmitted to the Company for the execution of the Programme, in accordance with the Data Policy.

To find out more about the data processing policy, Members are invited to consult the Privacy Policy available on the website.

5.2. Applicable Law and Disputes

These terms and conditions are governed by French law without prejudice to the mandatory consumer protection provisions applicable in the consumer's country of residence.

Consequently, the rights of cancellation/withdrawal, pre-contractual information, out-of-court dispute resolution and any other mandatory guarantees of the country of residence shall apply and prevail where applicable.

Consumers in the EU have access to an alternative dispute resolution (ADR) entity in accordance with Directive 2013/11/EU.

In France, consumers may refer the matter to the ‘consumer ombudsman’ (SAS Médiation Solution), in accordance with the T&C.

In the United Kingdom, WALIBUY refers consumers to an approved ADR entity (CTSI list) appropriate to the sector, without prejudice to recourse to the competent courts.

5.3. Unsubscribing from the Programme

  • Members may unsubscribe from the Programme at any time:
    Directly from their personal ‘My Account’ area, in the section dedicated to the loyalty programme.

Unsubscribing takes effect immediately and results in the immediate and permanent loss of all unused Points and Rewards.
